Tyranny reigns supreme in Boulder, Colorado.
The authoritarian Boulder City Council banned so-called “assault weapons” and in the process violated Colorado State Law and the Constitution of the United States of America.
Boulder’s city attorney, the man who wrote the “assault weapons” ordinance, argues that home rule exemption in the Colorado Constitution allows Boulder to pass a ban.
The problem with this argument is home rule exemption does not include NATURAL RIGHTS.
Dudley Brown of Rocky Mountain Gun Owners commented on that argument stating, “The home rule exemption doesn’t apply to everything and it certainly doesn’t apply to a fundamental right.”
A further issue with passing a gun ban in Colorado is the firearm preemption law that passed in 2003.
A local government may not enact an ordinance, regulation or other law that prohibits the sale, purchase, or possession of a firearm that a person may lawfully sell, purchase, or possess under state or federal law. Any such ordinance, regulation, or other law enacted by a local government prior to March 18, 2003, is void and unenforceable.
According to the law, the “assault weapons” ban passed in Boulder is “void and unenforceable.”
If this holds true, the citizens of Boulder have no reason to comply with the new ordinance.
But that has not stopped the tyrannical City Council from giving citizens 30 days to either register their rifle and obtain a permit, remove their guns from the city, turn their guns in to authorities, or destroy them.
Looking at the ordinance from the federal level, it clearly violates the natural rights afforded to citizens of the United States by the Second Amendment.
Furthermore, a lawsuit filed by Jon Caldara of Boulder, alleging the ordinance “violate[s] multiple provisions of the U.S. Constitution including Article VI, the First Amendment, the Second Amendment, the Fifth Amendment and the Fourteenth Amendment.”
